1. Acceptance of Terms

By hiring T & C Construction Services LLC (“Company,” “we,” “our,” or “us”) to perform construction, remodeling, renovation, or plumbing services, you (“Client,” “you,” or “your”) agree to these Terms of Service (“Terms”). If you do not agree, you must not request or use our services.

2. Scope of Services

We provide construction and remodeling services, including but not limited to:

  • Residential and commercial construction
  • Kitchen and bathroom remodeling
  • Basement finishing and conversions
  • Plumbing installation, repairs, and maintenance
  • Full property renovations

3. Service Areas

We serve the DMV

Maryland

Montgomery County, Prince George’s County, Howard County, Anne Arundel County, Baltimore County, Charles County, Frederick County & more

4. Estimates, Quotes, and Contracts

  • Estimates: All provided estimates are good-faith calculations and subject to change based on material costs, labor, and scope adjustments.
  • Contracts: No work begins without a signed service agreement outlining project scope, materials, timelines, and costs.
  • Change Orders: Any modifications must be approved in writing and may affect project costs and timelines.

5. Payment Terms

  • Deposit: A deposit of 30-50% is required before any work begins.
  • Progress Payments: For larger projects, staged milestone payments will be required.
  • Final Payment: Due immediately upon project completion unless otherwise agreed.
  • Late Payments: Overdue balances accrue 1.5% monthly interest and may result in project suspension.
  • Non-Payment: Failure to pay may result in legal action and mechanic’s liens against the property.

6. Client Responsibilities

  • Provide accurate property details and disclose any hazards
  • Secure necessary permits unless otherwise stated
  • Ensure clear property access for our team and equipment
  • Approve designs, materials, and change orders promptly

7. Permits and Regulatory Compliance

We comply with all applicable local, state, and federal building codes. Clients are responsible for obtaining required permits unless expressly included in the service agreement.

8. Warranties

Workmanship Warranty

We warrant our workmanship for one (1) year from project completion unless otherwise stated in writing.

Material Warranty

Manufacturer warranties apply to materials; we will assist clients with claims where possible.

Exclusions

  • Normal wear and tear
  • Third-party modifications or misuse
  • Acts of nature, fire, flood, or other external factors

9. Liability and Indemnification

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is capped at the total amount paid for the services
  • Clients agree to indemnify and hold us harmless against any third-party claims related to project execution

10. Project Delays

While we strive to meet timelines, delays may occur due to weather, supply shortages, permit issues, labor disruptions, or unforeseen site conditions. We are not liable for delays outside our control.

11. Termination and Cancellation

  • By Client: Cancellations after signing may incur fees covering labor, materials, and scheduling costs.
  • By Us: We may cancel if unsafe conditions, code violations, or client non-compliance arise.

12. Dispute Resolution

Any disputes shall first attempt resolution through negotiation. If unsuccessful, disputes will proceed to binding arbitration in the jurisdiction where the project is located. Maryland law governs unless otherwise required by local regulations.

13. Intellectual Property

All designs, plans, images, and documents created by us remain our intellectual property unless explicitly transferred in writing.

14. Privacy

We respect your privacy and only collect information necessary to perform services and maintain records. We do not sell or share personal data without consent.

15. Entire Agreement

These Terms, along with signed service agreements, constitute the entire agreement between you and T & C Construction Services LLC. No verbal agreements are binding unless confirmed in writing.
